Don’t be tricked by Suzuki! Suzuki GSX R-1000 motorcycle recalled.

Suzuki has sent a Voluntary Safety Recall to the buyers of their Suzuki GSX R-1000 motorcycle for the model years of 2005 and 2006.

As a motorcycle accident injury lawyer that has helped many seriously injured bikers after an accident all throughout North Florida, including Daytona Beach, for over 37 years, I found the wording of Suzuki’s recall to be vague and self serving. I sounds to me that Suzuki wrote this recall with the very intention of lawsuits in mind. In the recall, Suzuki writes that they are not responsible for any injuries or damages caused as a result of it breaking. However, they are legally responsible but, in the wording of the recall they are telling people they are not. Legally, if someone manufactures a defective product they are responsible. This recall is trying to trick people into not pursuing legal action against them.

In addition, according to the recall, “To reassure your confidence in your Suzuki GSX-R1000, Suzuki will provide a five year warranty on your frame and the frame reinforcement brace….” Remember, this warranty only provides protection for the bike, not the biker. Suzuki takes no responsibility for the biker seriously injured as a result of this major frame defect. However, just because Suzuki says they are not legally responsible does not make it so.

Anyone seriously injured as a result of this defective motorcycle should immediately consult an attorney.

Annie's Naturals Recalls Shiitake and Sesame Vinaigrette Due to Mislabeling

Annie's Naturals, in conjunction with the FDA, is recalling 686 cases of its all-natural Shiitake and Sesame Vinaigrette because it may contain wheat or soy, which was not included on the label. People who are allergic to soy or wheat may incur sever of life-threatening side effects.

So far the comapny has not received any reports of illness from the recalled product. The dressing was sold in grocery and natural food stores in selected states from December 20, 2007 to February 6, 2008.

Consumers can most easily identify impacted product by looking at the product labels - the front label says Shiitake & Sesame Vinaigrette, but the back label and ingredient statement say Low Fat Honey Mustard Vinaigrette. Only dressings with UPC # 0-92325-33319-2 with a Best By Date of 02/20/09/1/E and 02/20/09/2/E are affected.

The issue happened when there was a product changeover and the back labels for Honey Mustard Vinaigrette was mixed with the Shiitake Sesame Vinaigrette. The Honey Mustard Vinaigrette product was not affected because of the mixed up labels.

Originally posted at InjuryBoard by Jenny Albano

Spin Master Recalls Aqua Dots

Spin Master, in conjunction with the CPSC, is recalling about 4.2 million Aqua Dots because children have become unconscious and hospitalized after swallowing the beads.

The coating on the beads that causes the beads to stick to each other when water is added contains a chemical that can turn toxic when many are ingested. Children who swallow the beads can become comatose, develop respiratory depression, or have seizures.

So far two incidents have been reported to the CPSC. Two children who swallowed the Aqua Dots became dizzy and began vomiting and then fell into a comatose state. Both children, one of whom was only 20 months old, had to be hospitalized.

Aqua Dots are beads that are in a craft kit that are shaped to create multi-dimensional designs. When the beads are sprayed with water they fuse together to make the design permanent. All models of the product are being recalled; the kits include accessories such as a drying fan, applicator pen, design templates and the spray bottle.

The Aqua Dots were available in stores across the country from April 2007 to November 2007 and were manufactured in China.

For more information on this subject, please refer to our section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Jenny Albano

New FDA Program to Enhance States' Food Safety

The FDA announced they have launched a new national program to make sure state run regulatory programs for manufacturing, processing, and packing food are more uniform, equivalent, and are of high quality.

As of now, program regulations can vary from state to state. The FDA thinks these variations can lead to inconsistencies in the oversight of food safety. The national program's regulations will establish a uniform way of improving and observing the performance of each state's regulatory program and will help in reducing the risks of foodborne illness in food facilities.

The Manufactured Food Regulatory Program Standards are the result of five years of intensive cooperative effort by federal and state regulators. The standards define best practices for the critical elements of state regulatory programs designed to protect the public from foodborne illness and injury, including the program's regulatory foundation; staff training; inspection; quality assurance; food defense preparedness and response; foodborne illness and incident investigation; enforcement; education and outreach; resource management; laboratory resources; and program assessment.

All of these standards have self-assessment worksheets and some of the standards have supplemental worksheets to help state regulators make sure their program addresses all the elements of each standard. The program was approved by the U.S. Office of Management and Budget and will be tested first in New York, Oregon, and Missouri before the end of September.

Originally posted at InjuryBoard by Jenny Albano
